These Terms & Conditions, Delivery and Returns Policy (hereinafter referred to as the “Terms”) govern the ordering, payment, delivery, right of withdrawal, returns, product quality and other matters relating to purchases made through www.trimatevizija.com.

By placing an order, the Buyer confirms that they have read and agreed to these Terms.

1. Seller Information

The Seller is not registered for VAT.

If the Seller's VAT status changes, the information and prices displayed on the Website will be updated accordingly.

2. Scope of the Terms

These Terms apply to distance sales contracts for goods concluded through the Website.

For the purposes of these Terms, a Consumer means a natural person who purchases goods for purposes unrelated to their business, trade, craft or profession.

Where goods are purchased by a legal entity or by a natural person for professional or commercial purposes, specific consumer rights, including the 14-day right of withdrawal, shall apply only to the extent required by mandatory law or separately agreed between the parties.

3. Products and Characteristics of 3D Printing

A significant proportion of “Trimatė vizija” products are manufactured using FDM 3D printing technology.

Due to the nature of this manufacturing process, products may display:

  • visible layer lines;

  • layer seams or joining points;

  • minor variations in surface texture;

  • slight variations in colour between different production batches;

  • other minor characteristics typical of FDM 3D printing.

Such characteristics shall not be considered defects where they are consistent with the product description and information provided and do not materially affect the functionality of the product or its agreed intended purpose.

This provision does not in any way limit the Consumer's right to make a claim in relation to a genuinely defective, damaged, incorrectly manufactured or otherwise non-conforming product.

Product photographs are intended to represent the products as accurately as possible. However, colours displayed on screen may vary slightly depending on the device and display settings used.

4. Custom Orders and Design

“Trimatė vizija” may manufacture products according to the Buyer's individual requirements, dimensions, drawings, 3D models, logos or other information provided by the Buyer.

The Buyer must provide accurate and sufficiently detailed information necessary to fulfil the order.

Where a product is designed on the basis of dimensions or other technical information provided by the Buyer, the Buyer is responsible for the accuracy of the initial information supplied. The Seller is responsible for manufacturing the product in accordance with the specification agreed between the parties.

Before final production, the Seller may provide the Buyer with a 3D visualisation, drawing, prototype or another version of the design for approval.

A version approved by the Buyer becomes part of the agreed product specification. Such approval does not remove the Buyer's right to make a claim where the final product does not conform to the approved specification or otherwise has defects recognised under applicable law.

The Seller reserves the right to refuse a custom order where it is objectively impossible to manufacture, presents a safety risk, may infringe the rights of third parties, or cannot be fulfilled for other justified technical or legal reasons.

If the Seller is unable to fulfil a contract relating to an order that has already been paid for, the amount paid shall be refunded to the Buyer.

5. Placing an Order

The Buyer selects the products, product options and quantities required and provides the information necessary to place the order.

Before an order is submitted, the Buyer is provided with information regarding the main characteristics of the product, its price, delivery costs and any other applicable terms.

Once the order has been placed, an order confirmation is sent to the Buyer by email.

If an order cannot be fulfilled due to a technical error, an incorrectly displayed price, product unavailability or other objective circumstances, the Seller shall inform the Buyer as soon as possible and, where payment has already been made, refund the amount received.

6. Prices and Payment

All prices displayed on the Website are stated in euros (EUR).

The Seller is not registered for VAT.

Where delivery charges apply, they are displayed to the Buyer before the order is finally confirmed.

Payments may be made through Stripe or other payment methods made available on the Website.

At the final stage of the ordering process, the Buyer is shown the total amount payable before confirming the order.

7. Delivery

Products are delivered to the countries specified on the Website using postal services, parcel lockers or courier services.

The estimated production and delivery time may be specified on the relevant product page or during the ordering process.

Unless the parties agree otherwise, goods shall be delivered without undue delay and no later than within the period required by applicable law.

Delivery times provided by carriers may be estimates. In the event of a significant delay, the Seller shall cooperate with the Buyer and the carrier and respect the Buyer's rights under applicable law.

Until the Buyer or a person designated by the Buyer physically receives the goods, the risk of accidental loss of or damage to the goods remains with the Seller, except where the Buyer has independently selected a carrier that was not offered by the Seller.

If a parcel is visibly damaged upon delivery, we recommend, where possible, taking photographs of the condition of both the packaging and the product and contacting the Seller as soon as possible.

Delivery Outside the European Union

Where products are shipped to countries outside the European Union, import duties, taxes or other local charges may apply.

Unless expressly stated otherwise during the ordering process, such charges are not included in the price of the product or delivery and may be payable by the recipient in accordance with the laws of the destination country.

8. Consumer's 14-Day Right of Withdrawal

Where the statutory right of withdrawal applies, the Consumer has the right to withdraw from an online sales contract within 14 calendar days without giving any reason.

For contracts for the purchase of goods, the 14-day withdrawal period generally begins on the day on which the Consumer, or a person designated by the Consumer other than the carrier, receives the goods.

Where several products ordered under a single order are delivered separately, the withdrawal period begins on the day the final product is received.

To exercise the right of withdrawal, the Consumer must clearly inform the Seller of their decision to withdraw from the contract before the expiry of the 14-day period.

The Consumer may do so by:

  • using the “Withdraw from Contract” function available on the Website;

  • sending an email to info@trimatevizija.com;

  • submitting the model withdrawal form;

  • providing another unequivocal written statement expressing the decision to withdraw from the contract.

Where a withdrawal is submitted electronically through the Website, the Consumer shall receive confirmation of receipt without undue delay by email or another durable medium.

9. Returning Goods Following Withdrawal

After notifying the Seller of the decision to withdraw from the contract, the Consumer must return or hand over the goods to the Seller without undue delay and no later than 14 days from the date on which the Consumer notified the Seller of the withdrawal.

Return address:
Baltų pr. 117-25, Kaunas, 48202, Lithuania

Unless expressly stated otherwise by the Seller, the Consumer shall bear the direct cost of returning goods of satisfactory quality when exercising the 14-day right of withdrawal.

The Consumer has the right to inspect and handle the goods only to the extent necessary to establish their nature, characteristics and functioning.

The Consumer shall be liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

10. Refunds Following Withdrawal

Upon receiving the Consumer's notice of withdrawal, the Seller shall refund all payments received from the Consumer under the withdrawn contract no later than within 14 days.

The Seller may withhold the refund until:

  • the returned goods have been received; or

  • the Consumer provides reliable evidence that the goods have been sent back,

whichever occurs first.

The Consumer shall also be reimbursed for the original delivery costs up to the cost of the least expensive standard delivery option offered by the Seller.

If the Consumer chose a more expensive delivery method, such as express delivery, the additional cost of that delivery method shall not be refunded.

Refunds shall be made using the same payment method originally used by the Consumer, unless the parties expressly agree otherwise and provided that the Consumer does not incur any additional costs as a result.

11. Custom-Made and Personalised Products

The 14-day right of withdrawal does not apply where the product:

  • is not prefabricated and is made according to the Consumer's specific instructions;

  • is manufactured according to the Consumer's individual choice or specification;

  • is clearly personalised for a specific Consumer.

Examples may include:

  • a component designed according to individual, non-standard dimensions provided by the customer;

  • a component specifically designed to fit an object or mechanism provided or specified by the customer;

  • a product featuring an individual name, text, logo or QR code;

  • a custom product manufactured according to a 3D model or technical drawing provided by the customer;

  • a product whose geometry or construction has been specifically modified for an individual customer.

Before ordering such a product, the Buyer must be clearly informed where the 14-day right of withdrawal does not apply due to the customised nature of the product.

The fact that a standard catalogue product is manufactured only after an order has been received does not in itself necessarily mean that the product is considered individually personalised. The actual nature and extent of customisation shall be assessed in each case.

This exception does not affect the Consumer's rights in relation to custom-made products that are defective, damaged or do not conform to the order.

12. Product Quality and Statutory Guarantee

Goods sold to Consumers are covered by the statutory 2-year legal guarantee, calculated from the date of delivery.

The Seller is liable for any lack of conformity with the applicable product quality requirements that existed at the time of delivery and becomes apparent during the applicable legal guarantee period.

Where a defect becomes apparent within the first year following delivery, it shall, in the cases provided for by law, be presumed to have existed at the time of delivery unless the Seller proves otherwise or such a presumption is incompatible with the nature of the goods or the nature of the defect.

Where the goods do not conform to the contract or are defective, the Consumer is initially entitled to request:

  • repair of the product free of charge; or

  • replacement with a conforming product,

unless the chosen remedy is impossible or would result in disproportionate costs according to the criteria established by applicable law.

The Consumer may request a proportionate reduction in the price or termination of the sales contract in the circumstances provided for by law, for example where the product is not properly repaired or replaced, the defect recurs, the defect is sufficiently serious, or it is clear that conformity will not be restored within a reasonable period and without significant inconvenience to the Consumer.

Repair, replacement and any other mandatory remedies relating to goods of unsatisfactory quality shall be provided to the Consumer free of charge, including necessary postage or transportation costs where such costs are the responsibility of the Seller under applicable law.

13. Claims Regarding Damaged, Incorrect or Defective Goods

If you receive a damaged, incorrect or potentially defective product, please contact us at:

info@trimatevizija.com

To help us resolve the matter as quickly as possible, we recommend providing:

  • your full name;

  • order number;

  • product name;

  • a description of the issue;

  • where possible, photographs or other information supporting the claim.

Additional photographs or information shall only be requested to the extent reasonably necessary to assess the claim.

Consumer complaints are handled free of charge. A reasoned written response shall be provided no later than within 14 calendar days from the date the Consumer's complaint is received.

14. Intended Use and Safe Use of Products

The Buyer must use the product in accordance with the intended purpose stated in its description and any usage recommendations provided.

Unless expressly stated otherwise in the relevant product description, it must not be assumed that a product is certified for specialised or safety-critical applications.

Where applicable, the suitability of a product for any of the following uses will be expressly stated in the relevant product description:

  • contact with food;

  • children's toys;

  • exposure to high temperatures;

  • high structural loads;

  • medical applications;

  • vehicle safety systems;

  • other regulated applications.

This section does not limit or exclude any liability of the Seller that cannot legally be limited or excluded.

15. Intellectual Property Provided by the Buyer

By providing the Seller with a logo, graphic design, 3D model, drawing or other content for the purpose of a custom order, the Buyer confirms that they have the necessary rights to use such content and to provide it to the Seller for the purpose of fulfilling the order.

The Buyer grants the Seller the right to use such content only to the extent necessary to design and manufacture the specific order, unless otherwise agreed between the parties.

Where there are reasonable grounds to believe that a custom order may infringe third-party copyrights, trademarks, design rights or other intellectual property rights, the Seller reserves the right to refuse to fulfil the order.

16. Intellectual Property of “Trimatė vizija”

Original content, photographs, graphics, texts, logos, original 3D models and designs displayed on the Website may be protected by copyright, design rights, trademark rights or other intellectual property laws.

They may not be used for commercial purposes without separate permission to the extent that such use is restricted by applicable law.

The manufacture of a custom product for a Buyer does not in itself constitute a transfer of intellectual property rights belonging to the Seller unless the parties expressly agree otherwise.

17. Personal Data Protection

The Buyer's personal data is processed for the purposes of order fulfilment, payments, delivery, customer service and other lawful purposes.

Further information is available in our Privacy Policy and Cookie Policy.

18. Consumer Dispute Resolution

If a Consumer believes that their rights have been infringed, they should first contact the Seller in writing at:

info@trimatevizija.com

The Seller shall review the Consumer's complaint and provide a reasoned written response no later than within 14 calendar days.

If the dispute cannot be resolved directly between the parties, the Consumer may contact:

State Consumer Rights Protection Authority
(Valstybinė vartotojų teisių apsaugos tarnyba – VVTAT)
A. Goštauto g. 12, 01108 Vilnius, Lithuania

An application may also be submitted electronically through the Consumer Rights Information System (VTIS) at www.vtis.lt.

19. Applicable Law

These Terms and any contracts concluded under them shall be governed by the laws of the Republic of Lithuania.

Where a Consumer resides in another country and the Seller directs its commercial activities to that country, this provision shall not deprive the Consumer of any protection granted by mandatory consumer protection laws applicable in the Consumer's country of residence, where such laws apply.

20. Amendments to the Terms

The Seller may update these Terms in response to changes in legislation, the operation of the Website, delivery arrangements, payment methods or other business processes.

Each order shall be governed by the version of the Terms that was in force at the time the order was placed, except where mandatory changes in applicable law require otherwise.

The latest version of these Terms shall always be published on the Website together with the date on which they were last updated.
